TERMS OF SERVICE

Last updated September 11, 2026

These Terms of Service (the “Terms”) govern your access to and use of the Park It 365 websites, applications, parking-management platform, and related services (collectively, the “Services”) provided by H4 Towing, doing business as Park It 365 (“Park It 365,” “we,” “us,” or “our”).

By accessing or using the Services, creating an account, registering a vehicle or visitor, requesting or purchasing a parking permit, or otherwise indicating your acceptance, you agree to these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of a company, property owner, property manager, towing provider, or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

1. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. You may not use the Services if applicable law prohibits you from doing so.

2. THE SERVICES

Park It 365 provides technology for managing parking-related activities, which may include property and space administration, resident and tenant records, vehicle and permit management, visitor registration, paid parking, parking-rule administration, violation records, towing-related workflows, notifications, reporting, and payment processing.

Certain features, rules, prices, eligibility requirements, availability periods, enforcement practices, and refund terms may be selected by the owner, manager, operator, association, towing provider, or other authorized party responsible for a particular property (each, a “Property Operator”). Unless we expressly say otherwise in a separate written agreement, Park It 365 provides the technology platform and does not own or control the parking facility, guarantee that a parking space will be available, or independently establish the property-specific parking rules.

3. ACCOUNTS AND ACCOUNT SECURITY

  • You must provide accurate, current, and complete information and keep it updated.
  • You are responsible for safeguarding your login credentials and for activity conducted through your account.
  • You may not share credentials except with personnel you have authorized to act for your organization.
  • You must notify us promptly if you suspect unauthorized access or another security issue.
  • We may require identity, authority, vehicle, residency, tenancy, or payment verification before providing a feature.

You are responsible for ensuring that anyone you authorize to use your account complies with these Terms. We are not responsible for loss caused by your failure to protect account credentials, except to the extent applicable law provides otherwise.

4. PARKING PERMITS, VEHICLES, AND VISITORS

You must submit complete and accurate vehicle, license plate, contact, unit, visitor, and other requested information. A registration, confirmation, QR code, receipt, or permit issued through the Services:

  • applies only to the property, vehicle, person, space, and time period identified;
  • may be subject to approval, limits, expiration, revocation, and additional Property Operator rules;
  • does not transfer ownership, create a lease, guarantee a space, or authorize parking contrary to posted signs or law; and
  • may be invalid if the information provided is inaccurate, incomplete, duplicated, altered, or used by an unauthorized person.

You are responsible for reviewing and following posted signs, property rules, permit instructions, fire-lane and accessibility requirements, and applicable laws. You are also responsible for your guests and for vehicles you register. Property Operators may deny, suspend, revoke, or limit parking privileges as permitted by their rules and applicable law.

5. ENFORCEMENT, VIOLATIONS, AND TOWING

Parking authorization through the Services does not prevent ticketing, immobilization, relocation, or towing when a vehicle violates posted restrictions, applicable law, or Property Operator rules, or when registration information is incorrect or cannot reasonably be verified. Enforcement and towing decisions may be made by a Property Operator, towing provider, law-enforcement agency, or other authorized party.

Questions or disputes about a specific warning, violation, tow, storage charge, or enforcement decision should be directed to the party identified on the applicable notice, receipt, signage, or property communication. Nothing in these Terms limits any non-waivable rights or procedures available under applicable towing, parking, consumer, or other law.

6. FEES, PAYMENTS, AND REFUNDS

Some Services require payment. The price, billing frequency, taxes, processing charges, and other material payment terms will be presented at checkout, in an order form, or in another applicable agreement. By submitting a payment, you represent that you are authorized to use the selected payment method and authorize the disclosed charge.

Payments may be processed by Stripe or another payment processor. Your use of a processor’s services may be governed by its own terms and privacy notice. We do not directly store full payment-card numbers. Payment authorization, settlement, reversals, disputes, and refunds may be affected by processor and financial-institution rules.

Unless checkout, an order form, a Property Operator policy, or applicable law states otherwise, completed parking and permit purchases are non-refundable once the applicable parking or permit period begins. If you believe a charge is duplicate, unauthorized, or incorrect, contact us or the applicable Property Operator promptly using the contact information shown with the transaction. Approved refunds will generally be returned to the original payment method.

7. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

If you purchase a subscription or automatically renewing plan, the price, billing interval, renewal terms, and cancellation method will be disclosed before you agree to the charge. By expressly accepting those terms, you authorize recurring charges until cancellation. You may cancel using the method provided in your account, order form, invoice, or subscription confirmation. Cancellation takes effect as stated in the applicable offer and does not retroactively refund charges already incurred unless required by law or expressly stated otherwise.

8. ACCEPTABLE USE

You may not, and may not help another person to:

  • use the Services unlawfully, fraudulently, deceptively, or to violate another person’s rights;
  • submit false permit, vehicle, visitor, payment, identity, residency, tenancy, property, or enforcement information;
  • copy, sell, transfer, alter, counterfeit, or misuse a permit, access code, QR code, credential, or confirmation;
  • gain or attempt to gain unauthorized access to an account, system, property record, or nonpublic feature;
  • probe, scan, disrupt, overload, bypass, or interfere with the security or operation of the Services;
  • introduce malware or use automated means to scrape or extract data except with our written permission;
  • reverse engineer, decompile, or attempt to derive source code except where the law does not permit this restriction;
  • impersonate another person or misrepresent your authority or affiliation; or
  • use information obtained through the Services to harass, discriminate against, threaten, or harm another person.

9. USER CONTENT AND DATA

You retain any ownership rights you have in information, documents, photographs, messages, property rules, and other content you submit to the Services (“User Content”). You grant us a nonexclusive, worldwide, royalty-free license to host, copy, process, transmit, display, and otherwise use User Content only as reasonably necessary to operate, secure, support, improve, and provide the Services, comply with law, and enforce these Terms.

You represent that you have the rights and permissions needed to provide User Content and instruct us to process it. If you are a business or Property Operator, you are responsible for providing required notices and obtaining required permissions for personal information you submit or direct us to process.

10. PRIVACY

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the Services, you acknowledge that you have reviewed the Privacy Policy. A Property Operator may have a separate privacy notice that applies to its own handling of information.

11. ELECTRONIC COMMUNICATIONS

You agree that we may provide agreements, disclosures, notices, receipts, confirmations, and other communications electronically, including through the Services or by email, using the contact information you provide. You are responsible for keeping that information current. Where required by law, marketing messages will be sent only with the required consent and will include an available opt-out method. Transactional or service messages may continue when necessary to administer your account or an active parking transaction.

12. OUR INTELLECTUAL PROPERTY

The Services, including their software, design, text, graphics, logos, interfaces, and compilation, are owned by or licensed to Park It 365 and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, nonexclusive, nontransferable, revocable license to access and use the Services for their intended purpose. No other rights are granted.

If you provide feedback or suggestions, you allow us to use them without restriction or compensation, but you are not required to provide feedback.

13. THIRD-PARTY SERVICES

The Services may link to or interoperate with third-party services, including payment processors. We do not control third-party services, and their separate terms and privacy practices apply. A link or integration does not imply that we endorse every aspect of that service. Park It 365 is not responsible for a third party’s independent acts or omissions, except to the extent applicable law provides otherwise.

14. SERVICE CHANGES AND AVAILABILITY

We may modify, update, suspend, or discontinue all or part of the Services. We will provide notice when reasonably practicable if a material change adversely affects a paid Service. The Services may occasionally be unavailable because of maintenance, updates, emergencies, third-party failures, network conditions, or events outside our reasonable control. We do not guarantee uninterrupted or error-free operation.

15. SUSPENSION AND TERMINATION

You may stop using the Services at any time. We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay amounts due, used the Services fraudulently, or if suspension is necessary to protect users, Property Operators, third parties, or the Services. When reasonable, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property provisions, disclaimers, liability limits, indemnity, and dispute terms.

16. DISCLAIMERS

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PARK IT 365 DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DATA WILL ALWAYS BE ACCURATE OR AVAILABLE; OR THAT A PERMIT, REGISTRATION, OR PAYMENT WILL GUARANTEE A PARKING SPACE OR PREVENT ENFORCEMENT ACTION.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, PARK IT 365 AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO PARK IT 365 FOR THE APPLICABLE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. YOUR RIGHTS AGAINST A PROPERTY OPERATOR, PAYMENT PROCESSOR, TOWING PROVIDER, OR OTHER THIRD PARTY ARE GOVERNED BY YOUR RELATIONSHIP WITH THAT PARTY AND APPLICABLE LAW.

18. INDEMNIFICATION

To the fullest extent permitted by law, if you use the Services on behalf of a business, Property Operator, or other organization, that organization will defend, indemnify, and hold harmless Park It 365 and its owners, affiliates, officers, employees, and agents from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from that organization’s User Content, property rules, enforcement decisions, violation of law, misuse of the Services, or breach of these Terms. This section does not require indemnification for Park It 365’s own negligence, willful misconduct, or other liability that cannot lawfully be indemnified.

19. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing a claim, you and Park It 365 agree to make a good-faith effort for at least 30 days to resolve the dispute informally after one party provides written notice describing the issue and requested resolution.

Unless applicable law requires otherwise, any court proceeding arising from these Terms or the Services must be brought in a state or federal court located in Tarrant County, Texas, and each party consents to that court’s jurisdiction and venue. Nothing in this section prevents either party from seeking temporary or emergency relief, using an eligible small-claims court, or exercising a right that cannot be waived under applicable consumer law.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time. The “Last updated” date identifies the latest version. If changes are material, we will provide reasonable notice through the Services, by email, or by another appropriate method. Changes apply prospectively from their stated effective date. Your continued use of the Services after the updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to an update, you must stop using the affected Services.

21. GENERAL TERMS

These Terms, together with the Privacy Policy and any applicable order form or additional written terms, are the entire agreement between you and Park It 365 concerning the Services. If an order form or additional written agreement conflicts with these Terms, that agreement controls for the conflicting subject matter. If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets, or by operation of law. Headings are for convenience only.
